Terms and Conditions for Marketing Blue Man Group

Blue Man Group recognizes the power of various online marketing programs and welcomes the promotional efforts of its affiliates. However, as Blue Man Group worked hard building a strong and reputable brand name, it is necessary that we take steps to protect the brand and its reputation. With this in mind, we've developed policies regarding the following online programs.

Failure to comply with these policies is grounds for termination of your affiliate status.

Search Guidelines

Publisher partners shall not bid on, purchase or register any keywords, search terms or other identifiers that include the word "blueman" or variations thereof (for example "bluman", "bluemen", etc.) ("Proprietary Terms") for use in any search engine, portal, sponsored advertising service or other search or referral service. If we determine, in our sole discretion, that you have engaged in any of the foregoing activities or, as the case may be, refused promptly to comply with a request from us to exclude Proprietary Terms from any keyword as mentioned above, we may (without limiting any other rights or remedies available to us) withhold any referral fees otherwise payable to you under this Agreement and/or terminate this Agreement.

Your Site Guidelines

You hereby agree that your site will not, in any way, copy or resemble the look and feel of the Blue Man Group site nor will you do anything to create the impression that your site is our site or a part of our site, including without limitation, framing our site in any manner. You also hereby agree that your site will not contain any content from our site or any materials which are proprietary to Blue Man Group, except 1) with our prior permission or 2) the materials were obtained by you via the Partner Fusion site in accordance with the provisions hereof or the policies or instructions thereon.

You further hereby agree that your top level domain name does not and will not contain any of the following words: Blue Man, Blue Man Group, Blue Men, Blue Men Group, The Blue Man Group, Blue Man Ticket, Blue Man Show, Blue Man Las Vegas or any variation thereof.

Inappropriate advertisements (False claims, misleading hyperlinks) are not permitted.

Paid Search Listings Guidelines

Title & Descriptions & Display URL in general

In general, do not engage in practices which portray your site as Blue Man Group. You are not permitted to use the word "official" in any title.

The titles and descriptions must not be deceptive and must accurately reflect current promotions on Blue Man Group's site.

Titles
You may use Blue Man Group � but only in a sentence or as part of statement. � like "Buy Blue Man Group Tickets". Titles can not include Blue Man Group as a standalone statement.

Descriptions
Prohibited Activity. AFFILIATE shall not use the terms "Official," or "Blue Man Group" or "Blue Men Group" or "The Venetian Resort Hotel Casino" in its ad copy, or otherwise create the impression that an AFFILIATE website is owned or operated by Blue Man Group

Description must not be deceptive and must accurately reflect current promotions on Blue Man Group. Advertising coupons, discounts, lowest rate, cheap or percentages off face value ticket price is not permitted.

Examples of unacceptable titles or descriptions:

Unacceptable Title: Blue Man Group
Reason: Implies that your site is Blue Man Group
Unacceptable Description: The Only Place to Buy Tickets.
Reason: Implies tickets can't be purchased elsewhere.
Unacceptable Description: Official Blue Man Group Ticket Site.
Reason: Implies Blue Man Group runs the site.

Display URL

Affiliates must use their own web address as the display URL. Do not use Blue Man Group as a display URL

Any subdomain of blueman.com remain off limits.

E-mail Guidelines

Affiliates are prohibited from sending e-mails promoting Blueman.com unless pre-approved. Any affiliate violating this policy will be terminated immediately and all commissions will be forfeit.

Generally, Blueman.com does not allow its affiliates to engage in e-mail marketing. However, if you own directly gathered opt-in lists, such as a loyalty program or in-house list, and would like you to request permission to e-mail, please fill out our Request to E-mail form.

Affiliates agree to not engage in spamming, unsolicited e-mail and indiscriminate advertising. Lists hoping to be considered should reflect the guidelines established by the IAB's Ethical Email Guidelines.

Parasiteware Policy

Blue Man Group does not allow partners to promote via downloadable applications.
The Blue Man Group Affiliate Staff feels strongly that affiliates should be properly rewarded for their promotional efforts on our behalf.
The last thing we want to do is reward another party for stealing commissions. We know that there are software programs out there, downloaded by millions of Internet users, that replace tracking codes with their own. The affiliates that are using this software are increasing their commissions at the expense of others. We actively prohibit any and all known parasiteware companies from earning commissions.

USING SOFTWARE THAT REDIRECTS TRAFFIC IS STRICTLY FORBIDDEN BY BLUE MAN GROUP.

Please note that if you are using a traffic-redirecting product or are planning on implementing such a product, Blue Man Group will reject you as an affiliate. Blue Man Group welcomes all legitimate marketing efforts, but strongly opposes technologies that would take commissions from its hard-working affiliates.

We commend Partner Fusion and others who've recognized the need to address this growing problem.
